京津冀协同发展的法治保障:困境与应对

摘　　要：习近平总书记在十九大报告中深入阐述依法治国方略时强调"全面依法治国是中国特色社会主义的本质要求和重要保障……坚持依法治国,依法执政、依法行政共同推进,坚持法治国家、法治政府、法治社会一体建设",这是推动各项事业纳入法治轨道的基本遵循。京津冀协同发展作为国家确定的重大战略,更离不开法治的规制与保障,但在当前京津冀协同发展法治进程中,仍存在诸多法治困境,如区域规划的制定和实施法治化水平不高,区域合作协调机制的法律保障不到位,区域协同发展模式中法律规制手段不均衡,公共服务一体化的法制推动力不足,重大行政决策的公开化与民主化的法律约束力有待加强。为此,应当强化顶层设计的法治化,制定专门的区域规划法;加强协调机制的实效性,依法设立协调机构和明确机构职能;创新法律规制模式,保障市场机制积极作用的发挥;打破民生区域壁垒,法律强力介入公共服务领域;广泛调动各方积极性,提高重大行政决策的公开化和民主化水平。The coordinate development of Beijing-Tianjin-Hebei could not be implemented without convoy of rule of law,but in the recent process of the rule of law in Beijing-Tianjin-Hebei region,there still exists the dilemma of rule of law. The standards of the formulation of regional planning and the legalization implementing are not high enough,the legal protection of regional cooperation and coordination mechanism is not strong enough,in the mode of regional collaboration development,legal regulation means are imbalanced,and legal impetus of integration of public service is weak,the legal binding of public opening quality and democratization of significant administrative decision still need to be strengthened. Therefore,it is necessary to strengthen the legislation of top-level design and make special region regulation; strengthen the effectiveness of coordination mechanism,establish coordination institute and explicit the function of institute innovate regulation mode of law according to law,guarantee the positive functioned role of the market mechanism; break regional barriers of people's livelihood,let laws strongly intervene the field of public services,motivate the enthusiasm of all sides in a wide range,improve the standard publicity and democratization of significant administrative decision making.
