用能权相关法律问题辨析

摘　　要：中国正在积极探索构建用能权交易制度,与排污权交易、碳排放权交易、水权交易、节能量交易等其他同类制度相比,用能权交易制度具有自身独特之处,加强相关问题的理论研究对于用能权市场实践活动具有重要的指导意义。在阐明用能权的经济理论基础之上,从法律角度对用能权的概念及属性、初始用能权确权行为的性质、用能权与能源使用权的关系等问题进行了初步分析,认为用能权兼具公权属性和私权属性,当前不宜也不必在相关立法文件中对其法律属性予以明晰规定;初始用能权的确权行为属于行政许可,用能单位由此获得的用能权是一种特定的能源使用资格;用能权与能源使用权之间虽然没有包含或交叉关系,但是具有密切关联性。China is actively exploring the construction of the right of using energy trading system.Compared with other similar systems such as emission trading,carbon emission trading,water right trading and energy saving trading,the right of using energy trading system has its own uniqueness,and the reinforce of theoretical research on relevant issues is of great guiding significance for the practice of the market of the right of using energy.Based on the economic theory of the right of using energy,this article makes a preliminary analysis on its concepts,attributes,and the nature of the initial right of using energy＇s confirming act,and the relationship between the right of using energy and the right to use the energy.The right of using energy has both public rights attribute and private rights attribute,and its legal attribute is not suitable and necessary to be stipulated clearly in the relevant legislative documents.The initial right of using energy＇s confirming acts belong to the administrative license.And in this way,the company which obtains the using energy right has a specific energy use qualification.Although there is no inclusion or cross-cutting relationship between the right of using energy and the right to use energy,it is closely related.
