摘　　要：国际工程通常工期较长、专业复杂、涉及参与方众多,因此包含的合同数量也较多,这些性质决定了国际工程合同可能存在缺陷,为减少缺陷,在项目前期阶段加强对合同体系的研究尤其重要,前期阶段对合同体系进行充分策划可以减少由于策划不足引起的争议和索赔。合同策划的目的是通过建立合理的合同体系最大限度地保证工程项目目标的实现,其是项目组织策划的一部分。工程项目管理模式决定了合同模式,合同模式约定项目管理的内容和方式,对工程项目进行项目管理就是通过合同管理实现合同所约定的目标,进而实现各项管理职能。项目的合同体系与该项目采用的项目管理模式有关,各参与方的合同管理责任由合同模式确定,所以应依据不同的项目管理模式正确选择合适的合同体系,在实际操作中,一个项目通常有很多合同,合同关系比较复杂,本文以一个工业与民用建筑为例,构建不同项目管理模式下采用的合同体系,本文的研究给业主的合同体系策划和选择提供了参考和借鉴。International project involves long construction period, complex profession, many participants and numerous contracts, so the international project contracts may be full of defects and many uncertain factors. In order to prevent the disputes and claims which are caused by the original deficiency of contracts, prior-period contract system scheming is particularly important. General planning of the contract is to maximize the realization of the project objectives through building proper contract systems, and general planning of the contract is part of the organization planning.Project management mode determines contract mode.The content and manner of project management is determined by the contract management mode.And the project management functions arerealized by realizing the objectives of the contract. Project contract system related to the project adopts the mode of project management, the parties of contract management responsibility determined by contract mode, so should be based on different project management mode of right to choose the appropriate contract system. Project contract system related to the project management modedeterminescontract man- agement responsibility of the parties, so proper contract system should be chosen according to different project management mode. In practice, a project usually has a lot of the contracts, and the contract relationship is very complex, so based on an industrial and civil building, this paper build contract systems of different project management modes, which can provide reference and selection to the contract system planning of owner.
