国家赔偿领域中精神损害赔偿制度探析

摘　　要：2010年,修改后的《国家赔偿法》确立了精神损害赔偿制度,该制度的确立是一个历史的发展过程。事实上,国家赔偿中精神损害赔偿相关制度的内容很多地方都借鉴了民事侵权中精神损害赔偿制度的内容。本文根据我国《国家赔偿法》及相关司法解释,对精神损害赔偿制度的内涵、范围、原则、成立的前提条件和构成要件以及承担责任方式进行了界定,以期对公民合法权益的保护有所裨益。The revised law of the People＇s Republic of China on state compensation has been implemented on December 1,2010 and the system of spiritual damage compensation has been clearly established.The establishment of the system in the state compensation is a historical process of development.In fact,the content of the system of compensation for men- tal damage in the state compensation has been borrowed from many aspects of the system of compensation for mental damage in civil tort.According to the revised law of the people＇s Republic of China on state compensation and the judi- cial interpretation of our country,the principle of the connotation and scope of spirit damage compensation system,and the conditions of the elements of the liability have been clearly definitive,and the legitimate rights and interests of the people have been protected.
