摘　　要：在互联网金融犯罪中,关于作为前置法的行政法律、法规的缺失与抑制金融创新、违背刑法谦抑性的问题,理论界主要有两种观点:一种是前置法的缺失抑制了金融创新,影响了刑法谦抑性的表达;另一种是前置法的缺失并未抑制金融创新,"立罪至后"的立法逻辑并非刑法的谦抑本性。通过还原互联网金融主要业态的刑法风险以及理论争议的梳理,以入罪前提和刑法规制理念为切入点,认为有"具体数额"表征的社会危害性之入罪前提具有妥当性;坚持二次违法性的金融刑法理念,兼顾金融创新与金融秩序的利益平衡以及倡导"定性+定量"的金融刑法立法模式,凸显刑法的谦抑性原则。Based on the issues between the lack of administrative laws and regulations as the preliminary law and the breach of modesty and restraint of criminal law as well as the suppression of financial innovation in the Internet financial crimes, there are two main positions in theory：, one is that the lack of preliminary law has repressed the financial innovation and influenced the expression of the modesty and restraint of criminal law; the other one is that the lack of preliminary law has not repressed the financial innovation and the legislative logics of ＂crime in the back＂ has not been the nature of he modesty and restraint of criminal law. Through the reappearance of criminal risk about the main formats of the internet finance and the combing of the theory controversy, cricling around the premise of conviction and the regulatory ideas, it is concluded that the premise of conviction judged by the social harmfulness in the expression of ＂the specific amount＂ is proper, and it is suggested that we adhered to the second law priciple of justice taking into account the balance of the interests between financial innovation and financial order, and it is advocated that financial criminal legislation mode be a ＂ qualitative ＋ quantitative＂ legislation mode showing that the modesty and restraint of criminal law.
