摘  要:管制俘虏理论作为一个规范的理论分析工具被国际学界广泛地应用于政府能源监管、环境保护研究中,并随着实践的检验与锤炼而日臻完善。我国大气污染问题、雾霾事件常态化实与政府车用油品管制问题休戚相关。基于管制俘虏理论视角,我国车用油品管制低效的主要原因是管制机构拥有过大的行政自主权;产业利益集团积极的游说活动;政企管制合作产生的利益勾连;官员个体易被管制俘虏;"旋转门"创造更多俘虏条件等。纠正与防范管制俘虏应重塑整合政府油品管制力量;继续深化石油国有企业改革;积极培育发展社会监督力量。Abstract: As a normative theoretical analysis tool, regulatory capture theory has been widely used for the studies of governmental energy regulation and environmental protection by international academic circles. As being examined by practice, it is improving day by day. In fact, air pollution and the normalization of haze in China are both related to the problems in governmental regulation toward the quality of motor gasoline. Based on the regulatol~~ capture theory, the reasons that cause inefficient regulation include regulatol~~ agencies own broad and excessive administrative discretion; there are too many active lobbies from interest groups; cooperation between regulator and regulatee could result in the regulator being more concerned about profits, which opens the door to capture; the regulated industry's influence on individual official makes a regulatory agency susceptible to be captured; the regulated industry may gain influence over reg- ulatory agencies through the movement of personnel between the roles of regulator and regulatee-ofien referred to as the"revolving door" hypothesis. To correct and prevent regulatory capture, we should reshape and integrate all the powers of regulation from different agen- cies; continue to deepen the reform of state-owned oil companies; and develop the force of social supervision.
