摘  要:美国是我国企业最大目标市场。然而,我国企业已连续15年成为337调查的主要对象。一些企业缺席337调查,一些企业没有美国专利,还有一些企业缺乏被337调查风险意识或不了解337调查规则。我国企业败诉率达60%,败诉企业乃至相关行业侵权产品被迫退出美国市场。我国企业应提前做好应诉337调查准备,积极应诉抗辩,并请求政府、行业协会协助应诉,争取胜诉或和解,避免产品被禁止进入美国市场。The United States is the largest target market for Chinese enterprises. However, Chinese enterprises have become the main respondents of 337 investigations for the past 15 years. Some Chinese enterprises didn't respond to 337 investigations, some Chinese enterprises didn't have U.S.patents, and others were short of awareness of the risk of being investigated or ignorant of Section 337 Rules. The losing rate of Chinese enterprises is 60%. Chinese enterprises losing lawsuits and even the industry were forced to withdraw the infringing products from the US market. Chinese enterprises should be well prepared in advance to respond to 337 investigations, respond and defend themselves actively, and ask governments and industry associations for help in responding to win or reach a settlement, keeping articles from being excluded from entry into the United States.
