以天津赵春华案为例分析我国枪支管理法规的相关问题

摘　　要：2016年春节期间,天津某射击游戏摊位经营者赵春华因非法持有枪支被逮捕。该事件引起了广大群众以及媒体的关注,使我国枪支管理方面的法律法规面临新的考验。案件的争议焦点是仿真枪的定性问题。以非法持有枪支罪对赵春华定罪,从法理和人情的角度来说都是不妥的。对此,应当从个案的角度出发,以小见大,分析、研究我国枪支管理法规的现存问题,从枪支的立法、司法以及普法等多方面,进行规范与完善。During the Spring Festival in 2016, Zhao Chunhua, the operator of a shooting game booth in Tianjin, was arrested for illegal possession of firearms. The incident attracted the attention of the masses and the media, so that the laws and regulations of gun management in China are facing new challenges. It is inappropriate to judge Zhao Chunhua from the crime of illegal possession of firearms from the legal and human point of view. In this regard, we should, from the individual cases analysis of existing problems on Chinese gun regulations, srom the legislation, judicial and legal firearms and other aspects to standardize and perfect it.
