摘　　要：作为近年来法学界的研究热点,指导性案例的理论研究取得了丰硕的成果,但其在司法实践中的适用情况却不尽如人意。导致这种境况的主要原因之一是没有相应的适用方法、技术与细致规则。形成指导性案例适用的方法、技术与细致细则的关键在于进行事实要点相似性判断。进行事实要点相似性判断必须解决四个问题:为什么对比要点?对比什么要点?要点相似性需要达到的程度如何?最后,辅之以必要的例证说明要点相似性判断的过程,形成可资利用的指导性案例适用技术。在回答为什么对比要点的同时,还回答了指导性案例的性质、适用方式与技术性要求等问题。As a research hotspot in the field of law in recent years,the theoretical research of the guiding case has achieved fruitful results,but its application in judicial practice is not satisfactory. One of the major causes of this situation is the absence of appropriate applicable methods,techniques and meticulous rules. The key to the formation of methods,techniques and meticulous rules approaching to guiding case is to judge the similarity of facts. To determine the similarity of the facts must answer four questions： Why do you compare points？ What＇s the point of contrast？ To what extent does the point similarity need to be achieved？ In the end,the necessary examples are used to illustrate the process of judging the similarity of key points,and the applicable technology of guiding case can be formed. At the same time,this article answers the questions about the key points,and also answers the nature,the way of application and the technical requirements of the guiding case.
