摘 要:针对现行以计划经济为预设的管控本位论,既有矿产资源法理论的反思呈现倾向开放的私权基础论和折中的公私法二元兼顾论之争。这些理论在功能定位或者整体思考方面存在简单化倾向,无法从根本上革新矿产资源法的理论基础。以"国家—市场"多元利益整合的多重规范调整和规制的法律制度设计思路即"偏私型公私综合法论",无疑是矿产资源法理论基础重构的新视角,其核心是以私法机制为主导,兼顾公法调整,以作为物权的矿业权配置和运行为主要机制,并辅助以行政介入机制的一套规范体系。The theoretical analysis of mineral law currently focus on the dispute between the mechanism of private law and the mechanism of public-private combined legal mode,both of them oppose the government 's strict control. These opinions simplify the problems in the function of the respective legal institutions and do not pay enough attention on the overall legal system,which apparently can not build a new and better theoretical foundation for the mineral law. The mechanism of public-private combined mode based on the private law is a new theoretical view of this problem. It focuses on a multi structure of the legal institutions,which could integrate the interests of different subjective. This theory still based on the private legal rules,especially the property regulations,and combined with the public rules and administrative mechanism.
