略论重大火灾隐患防治与城市治理法制生态

摘　　要：以法制为核心依据的社会治理——尤其是关乎公共安全的城市治理,错综复杂,形势严峻,考验着执政者的智慧。重大火灾隐患存在与否及其治理成效,是测评消防安全环境优劣的主要参数,更是衡量政府治理能力的重要标尺。以重大火灾隐患防治法制现状为分析视角,提出如下观点:在法律过度概括和行政法规缺失的情况下,过于依赖地方立法很难解决纵横交叠、盘根错节的城市治理问题。城市治理是一个全方位贯通的系统工程,必须有权责明确、层级科学、配合严密的法制及相关规范体系的强力支持。The social governance based on the legal system,especially the city governance of the public security reflects the governor’s wisdom,which is in serious and complicated situation.The existence and control effectiveness of major fire potential are the main criterion of the regional fire safety environment and the capacity of the government.Based on the current legal system of major fire potential prevention and control,the views in this paper are concluded：it is difficult to solve the complicated city governance issues with overdependence on local legislation,the overgeneralization of law and the improper absence of administrative regulations;city governance is a systematic project with comprehensive connections,which highly demands the legal system with clearly-defined power and responsibility,scientifically-classified and well-coordinated legal system and related normative system.
