摘　　要：随着我国社会从互联网进入大数据时代,我国的电信网络诈骗也出现了更为复杂的犯罪样态,通过对近三年全国范围内电信网络诈骗犯罪的大数据统计分析,针对新形态下电信网络诈骗案件出现的新特点,应适当改变对于网络犯罪概念的传统刑法界定,进而在社会治安综合治理的视域下,从国家、行业、个人三个层面采用法律防控、技术防控、道德防控等多种防控手段,对电信网络诈骗犯罪进行综合治理,明确电信网络诈骗犯罪同其他犯罪的合理界限,尽可能将网络犯罪行为控制在罪前阶段,防患于未然。Cyber-frauds are emerging with more complicated forms along with China＇s progress into Big Data Era. This thesis analyzes the cyber-fraud cases in China in the past three years and summarizes newly-emerging features in this crime. It is suggested to perfect the conventional definition on telecommunication fraud and cyber-fraud in Criminal Law so that they can be rationally distinguished from other crimes. And it is imperative to combine law prevention ,technology prevention and mortality prevention in national, industrial and individual levels from perspectives of Social Order Comprehensive Governance. It can be expected that such cyber crime can be prevented in preparation stage.
