亲属法的性质问题探析

摘　　要：亲属法的性质是亲属法领域的基础性问题,其性质的界定不仅决定着其地位问题,即是回归民法、作为民法的一个组成部分还是作为一个独立的法律部门而存在,而且还涉及是否需要国家公权力的干预、干预的限度以及应将婚姻家庭领域的权利置于什么样的权利位阶进行保护的问题。鉴于此,有必要分析强调亲属法的私法属性的积极意义及其可能导致的弊端,同时提出了亲属法的公法化倾向问题。因为在亲属法领域,国家的干预不仅体现了"婚姻、家庭、母亲和儿童受国家保护"的宪法精神,而且有利于保障家庭弱势成员的利益。但为了避免干预的不当性,在具体案件中应引入比例原则来进行判断和限制。另外,随着人权入宪,我国亲属法的立法也应突出尊重和保障人权的精神和理念,应从人权的角度重新定位婚姻家庭成员的权利,以利于强化政府的保护义务,在立法、司法中体现社会性别意识,以此唤起民众、婚姻家庭成员对他人和对方的婚姻家庭权利的尊重。The nature of family law is a fundamental problem in the field of family law. The definition of its nature not only involves its status-whether the family law is part of the civil law or it should belong to an independent legal department. The nature of the family law also involve the problem that whether there should be national public intervention, limits on the intervention and the status of the marriage and family rights in the rights protection. The author emphasizes family law in the analysis of the private law attribute of the positive significance and its defects,and puts forward the relative method tendency of public law in question. Because in the field of family law, the state＇s intervention is not only embodies the＂marriage, the family and mother and child are protected by the state,＂the spirit of the Constitution, but also to safeguard the interests of the disadvantaged family. But in order to avoid improper intervention, the proportion principle should be introduced in specific cases to determine and restrict. In addition,with human rights into the Constitution and legislation of our country＇s relative law should also highlight the spirit of respect and safeguarding of human rights, from the perspective of human rights to reposition the rights of marriage and family members, to facilitate the protection by government obligation, reflect gender consciousness in the legislative,judicial, so as to arouse the respect from people, marriage and family members to each other＇s marriage and family rights.
