摘　　要：在一系列顶层设计的引导下,文化法的研究已成为法学研究的新趋势,然而目前对前提性的一系列重要基础概念的探讨却如雾里看花。在传统的"文化"概念界定困难的情况下,应摒弃直接界定的传统逻辑,转而在成文法的语境中间接定位法制层面"文化"的一般内涵。以此为基础,进一步甄别法制文化与文化法制直接的耦合与界分。由此产生的作为"法制文化"下位概念的"文化法制文化",其中前后两个"文化"的内涵又显然具有本质差别。在经过一系列复杂的主观加工之后,促成了"文化法制观念"的产生,其与"文化法制文化"虽然处于不同的维度,但却具有逻辑上的承接关系。"文化法制"的动态实施是形成"文化法治"的前提,而文化法制观念在这一形成过程中扮演重要角色。总之,除了文化法规范的良好建构,文化法制观念的发生、发育和发展也将在我国文化法治建设过程中发挥关键作用。According to series of top-level design,cultural law has become new trend of the science of law in China.But research on some relevant concepts are still ambiguous.Because of the difficulty to define the ＂culture＂via traditional logic directly,it is wise for us to get the definition just base on the legislation indirectly.Then,we should pay attention to the relationship between the ＂culture of legality＂and the ＂cultural legality＂.As the subconcept of the ＂culture of legality＂,there are two different cultural elements in statement of the ＂culture of cultural legality＂.Base on complex subjective process,it produced the ＂concept of cultural legality＂,which is in different location to ＂the culture of cultural legality＂but sharing the interlinked logic.The appearance of the ＂rule of cultural law＂is the result of implementation of the ＂cultural legality＂.Besides of the cultural legislation,the occurrence,growth and development of the ＂concept of cultural legality＂are playing key roles in the process of building the ＂rule of cultural law＂.
