我国专利行政处罚的权限冲突及其规制路径

摘　　要：我国长期以来在专利保护上实行行政执法与司法保护平行的"双轨制"模式。专利行政处罚是一个具有中国特色的知识产权保护制度,是对专利司法保护的必要补充。在我国现有知识产权行政执法体系下,有权查处专利侵权或违法行为的行政部门之间往往存在执法权限冲突的问题。究其原因,有专利事务本身的复杂性、法律法规的局限性、部门利益的驱动以及缺少争议协调部门等。从现有权限冲突的规制路径看,专利执法的行政协助、联合执法和综合执法对消减权限冲突所发挥的作用有限,以跨部门协作为主的行政协作机制是提高专利行政处罚效率的发展路径。为了顺应我国法治政府建设和行政体制改革的总体趋势,有必要从顶层设计的角度探索构建和完善跨部门的专利执法协作机制。最终目的是为了提高我国专利行政执法效益,维护权利人的合法权益,保障激励创新的市场竞争秩序。For a long time,our country has implemented the"two-track system"mode of parallel administrative law enforcement and judicial protection in patent protection.The administrative protection of patent is a system of intellectual property rights with Chinese characteristics.Under the administrative law enforcement system of intellectual property in China,there is often a conflict of enforcement authority between the administrative departments that have the power to investigate patent infringement or illegal acts.The reasons are the complexity of the patent affairs,the limitation of the regulations,the drive of the interests,and lack of the coordination department.From the view of the existing regulatory path of the conflict of authority,the administrative assistance of patent enforcement,the joint enforcement and the comprehensive law enforcement play a limited role in reducing the conflict of authority.The administrative cooperation mechanism,which is based on interdepartmental cooperation,is the development path to improve the efficiency of patent administrative punishment.In order to comply with the general trend of our government construction and administrative system reform,it is necessary to explore the construction and improvement of cross-section cooperation mechanism of patent enforcement.Finally,it is to improve the efficiency of patent administration enforcement in our country,to safeguard the interests of right holders,and to guarantee the market competition order that stimulates innovation.
