摘　　要：本文旨在维护未成年人各项合法权益和保护其身心健康发展,结合侵权责任法的立法现状和司法实践,通过逻辑分析法从概念上对学校体育伤害事故的范围进行了延伸和扩大、也从公平正义的角度建议对责任构成要件的法定。最后指出学校体育伤害事故的法律归责原则要以过错推定责任原则为主,辅之以公平原则。Pointed on the standpoint of safeguarding the lawful rights and interests of minors and protecting their physical and mental health. The paper combined the legislative status quo and judicial practice of tort liability law to extends and expands the scope of injury accidents in schools from the concept of justice according to adopt the method of logical analysis. It also suggests the statutory requirements on the elements of liability. At last, the au-thor points out that the principle of liability principle should be based on fault presumption and the principle of fair-ness.
