经济法与我国城乡利益分配整体格局变革

摘　　要：当下城乡的利益分配格局是失衡的,其制度上根本性成因就在于城乡二元分割体制。经济法是国家调节社会经济之法,经济法的国家调节是对市场机制的再调节,而在此过程之中,就是对业已形成的利益格局的再分配,同时也是基于社会本位实现实质正义的过程。对当下失衡的利益分配整体格局的变革,就需要在市场调节和民法调节的基础上,充分发挥经济法的再分配和差别保护的功能,综合运用经济法的国家调节和再分配功能,从而实现城镇和农村经济的协调、稳定和发展。Nowadays,The layout of benefit distribution on peasant is unbalance,the fundamental reason is the duality system between the city and the country.The Economical Law is the law which the country adjust society and economy,the adjust of the Economical Law is readjust to market mechanism,in this process,it is also redistribution of the former layout of benefit.To realize the transformation of the former unbalance integral layout of benefit distribution and the harmony,stabilization, development between the city and the country,it is necessary to apply fully the redistribution function of the Economical Law on the base of market adjust and the Civil Law adjust.
