摘　　要：在解决公共文化机构中的馆藏绝版作品数字化版权问题上,欧盟提出的解决方案是建立馆藏绝版作品数字化版权延伸性集体管理,其具有公益性、非商业性,集体管理组织主导等特点。我国可在借鉴欧盟立法经验的基础上,提出符合国情的公共文化机构中馆藏绝版作品数字化版权解决方案。On the issue of solving copyright in the digitization of out-of-commerce works of European public cultural institutions, the EU tries to establish an extended collective digitalization copyright management system of out-of-commerce works in the collections, which is a non-commercial system led by collective management organizations and serves public interest. On the basis of learning from EU legislation, we could put forward a reasonable proposal to solve copyright in the digitalization of out- of-commerce works in accordance with Chinese specific situation.
