民法典编纂中产品责任制度的完善

摘　　要：在我国民法典侵权责任编立法中,应当设专章集中规定产品责任制度,并对现有的产品责任制度予以完善。尤其是要将《产品质量法》中规定的部分产品责任制度纳入民法典之中,以实现法典中心主义。另外,该制度具体的完善建议主要包括:完善"产品"的概念并明确其范围、完善"产品缺陷"的概念和认定标准、明确产品责任的主体原则上限于生产者、完善产品责任的免责事由、明确违反产品跟踪观察义务的责任是过错责任、考虑合同法与侵权法的协调以完善相关规则。In the enactment of Tort Liability Part of Civil Code in our country, we should set up a special chapter focu- sing on the system of product liability and improve the existing system of product liability. In particular, it is necessary to incorporate parts of the product liability rules stipulated in the Product Quality Law into the Civil Code in order to realize the Co- dex- centrism. In addition, the specific suggestions for improvement of the system include： perfecting the concept of ＂product＂ and clarifying its scope, perfecting the concept of ＂product defect＂ and the standards of its identification, clarifying that the subject of product liability is in principle limited to the producer, improving the exemptions of product liability, clarifying that violating tracking and observing obligations of products is a liability for negligence, considering the coordination between the Contract Law and the Tort Law to improve the relevant rules.
