摘  要:中国农民工家庭的离散化流动造成大量儿童留守农村,也使他们遭遇身体侵犯问题,"仪式制度"则是深入透析问题的关键。倡导性的法理依据难以应用在案件的司法实践中,传统的实质伦理法则阻滞了法律规则法定权威的"落地",加剧了法律制度的"仪式化"和乡村"非诉讼化",使得施害者"搭便车"而逍遥法外,从而不利于对案件的预防与救济。可以说,国家现代化建设尚未走出现代性困局,作为价值照拂的法律制度又未发挥其解决实际问题的权威作用,一定程度上仅具有仪式形态的象征作用,乡村法治乃至国家法治还有待进一步完善。The separated migration of peasant-workers'families leads to a large number of children left behind in rural China,and these children have been confronted with body assault.Ceremony institution holds the key to in-depth look into the issue.It is difficult to apply the advocated legal basis in the administration of justice,and traditional substantial ethical law impedes the'landing'of legal authority of laws and regulations,two facts that add to the ritualization of legal system and non-litigation trend in rural areas,and as a result,offenders are at large,a situation unhelpful for the prevention of and relief in relevant cases.So we can say that the modernization of state has not gone out of modernity predicament,law system as value safeguard has not played the role of authority in resolving practical issues,and to an extent,only plays a role of ceremony symbol.Therefore,efforts have to be made to promote rule of law in China.
