摘　　要：从案件质量评估制度设定的指标及其所欲评估的内容来看,其是以案件处理的程序性形式结果对案件处理的实体公正性进行评估。将该评估结果作为对法官、法院绩效考评的依据,由法院内部有权主体进行评估,实际上是一种强管理行为。该评估制度极易使法官对数字化评估指标的关心超过案件处理的实体公正性。由于案件处理的实体公正性与评估结果的成本承担和利益享有在当事人与法官之间分属不同,因此,可能导致法官及其所在法院为追求个人或部门评估利益而致该评估制度对案件实体处理结果的影响更加复杂,亦更加难以预测。From the case quality evaluation system is set and the content of the free evaluation of index, in the form of case processing of procedural results to evaluate the entity justice of case treatment. The evaluation results as the basis of performance evaluation, the court of justice, to evaluate by the court shall have the fight to the main body, strong, in fact, a kind of management behavior. The evaluation system to judge the evaluation index of digital processing of entity justice concern over case. Due to the cost of the entity justice and evaluate the results of case treatment bear enjoys and interests, belong to different between the parties and the judge, thus will lead to the judge and its subordi- nate court interests in the pursuit of their own department or individual evaluation, and makes the evaluation system on the result of case entity processing is more complex, more difficult to predict.
