摘　　要：地质资料是人类探索地球的认识积累和客观记载,对于合理利用保护矿产资源和地质环境、推动地质科技创新具有极为重要意义。在实践中地质资料汇交责任制度不到位、地质资料汇交激励约束机制不健全、地质资料汇交监管范围不全面、尚未建立适应信息化要求的地质资料技术标准体系、矿业权人管理制度的不完善、汇交主体对汇交规范的熟悉不够是特别常见的问题,故2016年1月国土资源部通过公布第64号令对《地质资料管理条例实施办法》进行修改;2016年2月国务院通过第666号令对《地质资料管理条例》进行修改。2017年1月18日国土资源部发出《国土资源部关于加强地质资料管理的通知》,即(国土资[2017]1号文件),对于现存成果和原始地质资料管理提出:按"简政放权、放管结合、优化服务"的要求,为进一步完善制度,加强地质资料管理,提高服务水平,并罗列了具体要求。汇交制度是地质资料法律规范系统的核心制度,论文试图通过解读汇交制度对地质资料法律规范系统的构建方法进行探索。The geological data is the accumulation of human understanding of the Earth and objective records, which is of great significance for the rational use of the mineral resources, the protection of the geological environment and the promotion of the scientific and technological innovations in geology. In practice, the common problems are as follows： The responsibility system of the geological data collection is not in place, the incentive and restraint mechanisms in the geological data collection are not complete and comprehensive, the scope of supervision of the geological data collection is not complete, the geological data technology standard system which should meet the informatization requirements has not been established, the system of mining rights management is not perfect, the collecting system subjects are not familiar with the collecting system regulations which are very common problems. Therefore, in January 2016, the Ministry of Land and Resources issued No. 64 Ordinance to amend ＂Implementation Measures for the Geological Data Management Regulations＂; In February 2016, the State Council approved No. 666 Decree to amend ＂the Geological Data Management Regulations＂. On January 18, 2017, the Ministry of Land and Resources issued ＂the MLR Notice on Strengthening the Management of Geological Data＂; （GTZ （2017） No. 1 Document of Ministry of Land and Resources）. Concerning the management of the existing S＆ T achievements and the original geological data, MLR has proposed to fiarther improve the system, strengthen the management of the geological data and improve the service level based on the principle of ＂Streamlining administration, delegating more powers to lower-level governments and society, improving regulation and optimizing services,＂ and listed more specific requirements.
