病历全公开背景下医患权益平衡的探讨

摘　　要：以深圳的病历全公开政策实施为研究对象,结合了我国病历公开的历史、政策及实践背景。从支撑政策实施的相关法律法规和从法理角度提出的法律约束条件为切入点,对患方拥有获取其全部病历资料信息的权利以及病历全公开作为患方权益归位的政策合法性进行了系统阐述。同时从平衡医患权益的角度,结合病历全公开对于患者权益保障、医疗机构诊疗行为规范以及医患互信等带来的利与弊进行了深入分析。研究发现病历全公开将对促进医患权益平衡产生深远影响,并不断推进医疗行业诊疗规范化进程,推动医学科学的持续创新与突破,实现医疗机构科学有效管理。针对可能存在的问题总结出具体对策与建议,以期对病历全公开背景下医患权益平衡发挥参考意义。The research object is a policy of ＂Full disclosure of medical records＂ from Shenzhen, which combines the history, policy and practice. The authors illustrate the patient＇s right for obtaining full of medical records and its policy legality from the entry point of implementing the policy supported by laws and regulations and the constraint condition filed by legal. Meanwhile, the paper make a deep analysis of the advantages and drawbacks accompanied by ＂Full disclosure of medical records＂ from the angles of patients, medical staff and medical institutions by balancing the relations between patients and doctors. This research reveals that the policy of ＂Full disclosure of medical records＂ will promote the scientific management of medical institutions, relieve the tension between doctors and patients and develop innovative medical development patterns. Based on these underlying issues, the authors propose specific countermeasures and suggestions from three aspects： patient rights protection,hospital internal management and social trust.
