摘 要:地方层面应对气候变化是气候多层治理的重要环节,并发挥着越来越重要的作用。中国的青海省和山西省已颁布和实施了应对气候变化办法,在通过应对气候变化促进地方发展、实施预防性和全过程性的制度、将应对气候变化纳入业绩考核等方面进行了地方立法探索。但是,当前地方气候立法存在立法的不成熟性;政府职责不明确;规范内容过于原则,缺乏可操作性;承载功能具有局限性等问题。今后中国地方气候立法需要在提高立法层级、完善管理体制、加强与相关立法的衔接等方面努力。Addressing the climate change on a local level is an important part in the multi-layered governance of the global climate, and will play an increasingly important role. Qinghai and Shanxi Province have promulgated and implemented the approach to address climate change, and they have made local legislation through coping with climate change, promoting local development, implementing preventive and full process system, and incorporating climate change into performance assessment. However, the local climate legislation currently exist some problems, such as Immaturity legislation; government responsibilities are not clear; specification is too principled or declaratory, lack of maneuverability; bearing function limitations. In the future, China's local climate legislation needs to improve the legislative level, improve the management system, and strengthen the convergence with relevant legislation.
