《立法法》中立法权限与立法程序规定的贯彻问题——以《刑法修正案(八)》和《刑法修正案(九)》为基础的分析

摘　　要：《立法法》规定了全国人大及其常委会的立法权限和一般立法程序。《刑法修正案(八)》和《刑法修正案(九)》都是全国人大常委会以修正案的形式对1997年《刑法》作出的修改和补充,其中刑法总则性规定的修改中涉及剥夺重大权益的内容违反《立法法》中全国人大与全国人大常委会立法权限划分的规定;刑法内容修改中存在违反《立法法》关于全国人大常委会修法权限的现象;刑法修改的内容中存在违反《立法法》关于立法程序规定的现象。有必要采取《立法法》修正案和法律解释的方式,对于全国人大及其常委会关于刑法等基本法律的立法权限与立法程序做出更加明确、更加具体化、操作性更强的规定。Legislation Law defines the legislative power and general legislative procedure of the National People＇s Congress and its Standing Committee. Both the Eighth and the Ninth Amendment to Criminal Law are the modifications and supplements to the 1997 Criminal Law in the form of amendment acts by the Standing Committee of NPC, while the contents of depriving the major interests in the revision of the general provisions of Criminal Law violates the provisions concerning the division of the legislative authority between NPC and its Standing Committee in Legislation Law. Secondly, some modifications in Criminal Law violate Legislation Law that stipulates the revision authority of the NPC. Thirdly, some modifications in Criminal Law violate Legislation Law that stipulates the legislative procedure. It is necessary to make more definite, concrete and operative provisions, by means of Amendment to Legislation Law and legal interpretation, on the legislative procedure and the legislative power of the NPC and its Standing Committee in the matter of Criminal Law and other basic laws.
