如何理解党内法规与国家法律的关系——一个社会系统理论的角度

摘　　要：从法律系统出发考察党内法规与国家法律的关系,存在"合法即合法"的"套套逻辑",难以走出观察的理论困惑(彻底完整性)。借助社会系统理论的视角,能够避免"因为法律,所以法律"的一阶观察描述的同一性(自我指涉)。创新理解党内法规与国家法律的关系,需要重点从方法论与内涵逻辑两个维度加以把握。功能分化背景下社会系统的"自创生"运作,为法律系统与党规系统的分出与特定化奠定了前提。在如何理解关系的方法论上,"二阶观察"与"结构耦合"是解"套套逻辑"的关键。党内法规作为政治系统的子系统以及政治与法律耦合结构的基本定位,是理解党规国法关系的潜在问题。最终,在引入"系统/环境"的区分作为二阶观察的基础上,提炼出党内法规与国家法律的联系与区别及两者的关系逻辑。There is a tautology that ＂legal is legal＂ when we talk about the relationship between CPC＇ s internal rules and state laws from the perspective of the legal system. Thus, it is difficult to overcome the theory confusion in observation （completeness）. With the help of social system theory, we will avoid the self- reference of the single dimensional observation that law is what law deems to be law. To understand the relationship between CPC＇ s internal rules and state laws in an innovative manner, we should focus on the two dimensions of ＂how＂ and ＂what＂. The auto-poetic operation under the background of functional differentiation provides the precondition of the disengagement and specialization of the legal system and party s rules system. When it comes to the methodology of understanding the relationship, ＂Two Dimensional Observation＂ and ＂Structural Coupling＂ are the key points to unfold the tautology. In addition, there is also a potential problem that CPC＇ s rules is the coupling medium of politics and law, as the party＇ s rules are the subsystem of the political system. Finally, on the basis of introducing the two dimensional observation of ＂environment/system＂, define the relationship between CPC＇s internal rules and state laws, as well as the logic of the relationship.
