同一认定理论在侦查学中的科学定位略论

摘　　要：关于同一认定理论的定位问题存在着不同的观点,本文通过对各种观点进行简要评析,着重讨论同一认定理论在侦查学中的科学定位问题,同一认定理论集中反应了侦查认识的特点,对犯罪侦查活动都具有方法论的指导意义,在侦查学中的定位不能扩大化、绝对化。同一认定理论不是侦查学的基础理论,是侦查学中的一种重要的认识方法。It has different views about positioning of the same theory.This article makes brief analysis for the various viewpoints,focuses on the scientific orientation of the same identified theory in the criminal Investigation,Identification theory reflects the characteristics for detection of understanding,which have guiding significance of the criminal investigation activities,so the positioning in the criminal Investigation could not be expensed and absolute.The same identified theory is not the basic theory of criminal investigation but is an important understanding ways of it.
