摘　　要：完善凸显刑罚本质和惩罚功能的社区矫正管理体制已经成为我国现代刑罚执行制度改革的当务之急。推进这项改革的基本路径应以社区矫正刑罚本质法理重塑为核心,从而弥补社区矫正刑罚功能缺失的缺陷,确立社区矫正刑罚目的的价值取向;同时,以社区矫正管理体制法律完善为重心,尽量克服社区矫正管理体制不顺的制度弊端,合理配置刑罚执行权能、不断提升刑罚执行效益。The reformation of community correction＇s management system with the essence and function of punishment manifested,become the most important and urgent task among the reforming of modern Chinese penalty execution. The basic way to promote the reform is proposed to take the legal principle reconstruction of community correction on the essence of punishment the center of gravity,remedy the legal deficiencies of community correction in the absence of the function of punishment,therefore establish the punish function value orientation of community correction. At the same time,take the legal reconstruction of community correction management system as the center of gravity,that overcoming the system malpractices,make rational allocation of powers and functions,and improve the effectiveness of penalty execution.
