自治组织视角的医患纠纷调解机制——基于启东医调委的案例研究

摘　　要：信任危机引发的医患纠纷难以由医患双方化解,需要第三方介入。"医调委"成为化解医患纠纷首选,发挥着越来越重要的作用。但是有关"医调委"的组织性质、形成机制、工作机制等鲜有研究,影响了"医调委"的普及和缺乏相应的理论指导。本文基于自治组织理论,通过江苏省启东市医调委的案例研究发现:"医调委"本质上是一种跨行业的自治组织,重大医患纠纷事件的频发会促成"医调委"的成立;"医调委"能够有效地平衡医患双方权益、缓解重大医患纠纷事件的影响,并降低纠纷升级;政府对"医调委"的"间接的高度介入"更能够发挥"医调委"It is difficult to deal with doctor-patient disputes by both medical institutions and patients because of trust crisis between them. Therefore, the third party becomes important to solve these problems. Medical Mediation Commission （ MMC ） plays an increasing key role in the mediation of medical disputes. However, its nature, formation and mechanism have not been studied fully. In this paper, from a perspective of self-regulatory institution, a case study of Qidong MMC finds that： firstly, the MMC is a cross-industrial quasi-self- regulatory institution, and the frequent occurrence of major medical disputes may lead to the establishment of the MMC. Secondly, there are two roles of MMC. One is the MMC may balance benefits between two partners effectively, and the other is MMC can eliminate negative influence of severe medical accident and decrease the upgrades of the negative influence. Finally, the relationship between MMC and the local government is an important contingent factor impacting the mediation function of MMC. The local government with indirect and higher intervention will have a positive effect on mediation results.
