摘　　要：为解决科研数据垄断问题,学界提出相关对策,即转变学术交流模式、优化馆藏资源建设方案、完善法律法规体系、善用谈判策略、获取多方支持。在对上述对策进行述评的基础上,提出科研数据知识产权流转的命题。知识产权流转是对科研数据垄断问题的理论回应,研究科研数据再利用中知识产权流转问题可以弥补上述对策难以权衡主体之间利益的缺点,具体应从科研数据再利用中知识产权流转规则、产权归属、流转内容和价值评估四方面展开研究。In order to seek the solution of monopoly of scientific research data, many researchers put forward countermeas- ures, such as changing the mode of academic exchanges, optimizing the construction scheme of collection resources, improving the system of laws and regulations, using negotiation strategies skillfully and obtaining various support. On the basis of reviewing the a- bove countermeasures, this paper puts forward the proposition of the intellectual property rights transfer of scientific research da- ta. Intellectual property transfer is the theoretical response to the monopoly of scientific research data. Research on intellectual prop- erty transfer in the reuse of scientific research data can make up for the disadvantages of weighing interests among stakeholders. The study should focus on the following four aspects ： rules of intellectual property transfer, ownership of property rights, content of in- tellectual property transfer, and intellectual property value assessment.
