摘　　要：生态保护补偿是对生态保护者作出特别牺牲的补偿,流域生态保护补偿是其重要形式。目前,我国流域生态保护补偿在实施过程中面临着"合作与博弈"的横向府际治理难题。对此,本文认为,应加快立法进程,确保充分的法律供给,以生态法治理念主导流域生态保护补偿制度的构建,促进政府间流域生态保护补偿纠纷处理的司法化运行。这样,才能使我国流域生态保护补偿实践摆脱府际治理困境,更加符合生态文明建设和生态法治的要求。Ecological protection compensation is the compens ation for the special sacrifices of the conservationists,with regional ecological protection compensation as an important form. Currently,the regional ecological protection compensation in our country,in its implementation, faces the difficulty of horizontal intergovernmental governance of ＂cooperation and competition＂.In this regard,this papers holds that ecological civilization construction is a systematic project which needs the unity and cooperation of local governments at all levels to promote the smooth progress.It is necessary to speed up the legislative process to ensure adequate legal support,advance the construction of regional ecological protection compensation mechanism with the concept of ecological rule of law,advance the judicialization of disputes handling of intergovernmental regional ecological protection compensation,so as to help the regional ecological protection compensation practice in our country get rid of intergovernmental governance difficulties,which is more in line with the requirements of ecological civilization construction and ecological rule of law.
