摘　　要：民间文学艺术作品的版权保护是国际上已经持续讨论了很久的重要议题,但至今尚未形成一个能够被各方普遍接受的国际条约。我国已于2014年公布了《民间文学艺术作品著作权保护条例》(征求意见稿),但立法工作尚未最后完成。其中一个亟待解决的难题是,如何正确认定那些应当属于版权法保护的民间文学艺术作品。本文试图追溯民间文学艺术表达版权保护国际议题的缘起,将《伯尔尼公约》《突尼斯示范法》《保护民间文艺表达免遭滥用国内立法示范条款》等有关规定,与《民间文学艺术作品著作权保护条例》作比较,结合我国司法审判中已经有结论的两起案件及另外两件有可能纳入民间文学艺术作品范畴的典型事例,探讨民间文学艺术作品的认定标准和方法,为将来通过的相关立法和法律实施提供理论参考。Copyright protection of the works of folk arts is an important topic that has been discussed internationally for a long time. However,an international treaty which is universally accepted by all parties has not yet been formed. In 2014, China drafted the Regulations on the Copyright Protection of the Works of Folk Arts（draft for comment）, but the legislative work has not yet been finalized. One of the difficult problems to be solved is how to correctly identify those works of folk arts that should be protected by copyright law. This article attempts to trace the origin of international issues in the copyright protection of the expression folk arts,making a comparison between the Regulations on the Copyright Protection of the Works of Folk Arts and the Berne Convention, Tunis Model Law, and Model Provisions for National Laws on the Protection of Expression of Folklore against Illicit Exploitation and other Prejudicial Actions and other provisions, combining the two cases that have been concluded in China＇s judicial trial and two other typical cases that may be included in the scope of the works of folk arts, trying to find the criteria and methods for the identification of the works of folk arts, in order to benefit the relevant legislation and its implementation in the future.
