摘 要:我国相关政策积极鼓励高校教师兼职创新创业,但高校教师兼职发明创造的专利权归属依然处于灰色地带。"本单位"的双重性、"本职工作"的双重性和"物质技术条件"的双重性是教师兼职发明创造的专利权归属认定模糊的原因。对教师兼职发明创造的专利权归属认定的主要要素包括研发起止时间、研发地点和研发主要利用的物质技术条件。合同约定优先和兼职研发独立性是解决兼职发明创造专利权归属的主要对策。The relevant policies of our country actively encourage college teachers to work part-time to innovate, but the ownership of part-time inventions by college teachers is still not clear. The duality of the "employer", the "work" and the "material and technical resource used in inventions" are the reasons for the debate of the patent right of the teacher's part-time invention. The main factors that determine the ownership of the teacher's part-time inventions include the starting and ending time of the study, the location of the study and the main material and technical resource used in the invention. Priority to use contractual agreement and making the study independent are the main countermeasures to solve this problem.
