公众认同视阈下我国社区矫正问题反思

摘　　要：社区矫正的公众认同贯穿于社区矫正运作的每一个环节,是其发展过程中不可或缺的社会心理基础,也是各方面的社会力量充分有效参与的前提。按主体身份的不同可以将社会公众认同分为两个层面:广义上的社区矫正公众认同是社会民众或国民对于社区矫正制度的抽象认同;狭义上的社区矫正公众认同是社区矫正工作主体对这项制度的认同。制约不同层面的社会公众对社区矫正的认同的因素既有共性,更有差异。社区矫正公众认同的不足,使其背离了社区矫正制度设计的初衷。应对社区矫正公众认同的不足可以从思维层面的转变、社区建设的推进、顶层设计的修正三个方面寻求对策与出路。Public acceptance runs through the whole process of the operation of community correction,which is an indispensable social psychological foundation for its development as well as a precondition for the social power to effectively participate in such a job.The social public acceptance can be divided into two levels according to the differences of public identity.In a broader sense,public acceptance means the public or citizens have an abstract acceptance of the system of community correction.In a narrow sense,it means the workers on this job accept such a system.Social public＇ s acceptance of community correction system at different levels is both shared and varied.The lack of public acceptance of the community has left it to deviate from the original intention of the system.In re-sponse to these problems,we can adopt strategies and methods such as the transformation of the mind,the promo-tion of community building and the design of the top layer of system to improve public acceptance of community cor-rection system.
