国家职能:警察权形成的前提

摘　　要：国家是阶级社会特有的组织形态,国家职能是国家进行政治统治和社会管理的职责和功能,反映和引领着国家活动的基本方向。国家的政治职能就是政治统治职能,通过运用暴力、法制和强制力来维护政治秩序、社会秩序,控制和镇压敌对势力,是国家权力及其警察权形成的前提。警察权源于国家的政治职能,为履行国家职能而设置,目的在于保障国家安全和维护社会秩序。警察权的确立和形成,是根据国家职能的分工和需要,从国家权力体系中分设的结果。The state is the unique organizational form of class society.The national function is the responsibili-ty and function of the state for political rule and social management,reflecting and guiding the basic direction of na-tional activities.The state＇ s political function is the political rule function,which is the precondition for the forma-tion of state power and police power through the use of violence,legal system and coercive power to maintain politi-cal order,social order and control and suppress hostile forces.The police power is derived from the political func-tion of the state and is set up for the fulfillment of the functions of the state with the aim of guaranteeing national se-curity and maintaining social order.Based on the division of labor and needs of the state function,the establish-ment and formation of police power is the results of the separation of the state power system.
