企业海外经营“疏通费”刑事法解析

摘　　要：近几十年,中国资本广泛进入国外市场并且在国际经济交往中发挥着越来越重要的作用。与此相应,中国企业海外经营中的"疏通费"及其法律判断也逐渐提上了研究日程。为有效应对此类问题,需要深入研究、借鉴国外立法经验,通过增加"疏通费"法律规定、强化企业内控机制建设等措施来完善我国的防治体系。Over the past decades,Chinese capital has entered into the foreign market and played an increas-ingly important role in international economic exchanges.Therefore,facilitation fee occurred in the process of Chinese enterprises＇ overseas operation has been on the agenda of research as a legal issue.To effectively deal with these problems,it is needed to study and draw lessons from foreign legislative experience to improve the prevention and control system of our country by adding "facilitation fee" laws and regulations and strengthening the enterprise internal control mechanism.
