Research on the Autonomy of International Sports Organizations in the Legal Perspective

摘　　要：国际体育组织自治,主要是非政府、非盈利的体育组织在不受外界干预的条件下自己管理自己,自己立法、自己遵守、自己执行的一种行业治理体制。本文通过文献资料法、逻辑分析法,提出国际体育组织作为体育自治的主体,在对外交往中展现出了其在政治、经济、法律中的独立性和自治性。依据体育规章以及法律法规的授权,国际体育组织具有规章制定权、管理权、惩罚权、争端解决权的自治权力。尽管政治、司法权力的介入及权力本身的异化形成了国际体育组织组织实现自治的障碍,但若能够确立国际法主体地位、建立外部监督体系以及引入适当的司法权力保障,国际体育组织的自治就能够得到完善并最终走向善治的向度。Sports autonomy mainly refers：non-government,non-profit international sports federation＇s self-governance without the interference of government and political power and follows the rule of self-governence and self-law making.By using literature review and logical analysis,this study found out,international sports federations are the main body of sports autonomy,which shows the character of independence and autonomy in politics,economics and law.Under the authority of regulations and laws,which has the right of rule-making,management and punishment.Although some obstacles existed in sports autonomy due to the interference of political power,national judicature and alienation of power,sports autonomy could be perfect by authenticating the dominant position of international law,establishing an external supervision system and proper judicial protection.
