法官错案责任追究制度探析

摘　　要：十八届四中全会以来的司法体制改革要求法官实行办案质量终身负责制和错案责任倒查问责制,对于法官办理案件提出了更高的要求,但是目前我国的法官错案责任追究制度则与司法独立,司法规律相违背。故本文从当前我国法官错案责任追究的现状结合当前司法改革的大背景提出完善法官错案责任追究制的建议。The reform of the judicial system since the fourth Plenary Session of the 18 th CPC Central Committee asked the judge to practice handling quality lifelong responsibility and accountability for the investigations responsibility for misjudged cases.When handling the case,the judge puts forward higher requirements,but at present,our country＇s system of the liability of misjudged cases and judicial independence,which is contrary to the laws of justice. So this paper puts forward improvement suggestions for the liability of misjudged cases from the background of the current situation in China with the current judicial reform.
