摘 要:德国《商法》第5编"海商"的修订于2013年生效。中德两国航运经济形势以及对《鹿特丹规则》所持态度存在相似性,因而德国海商法改革对我国海上货物运输承运人责任制度的进一步完善具有借鉴价值。我国《海商法》修改时应当借鉴德国海商法改革的部分内容,将承运人责任期间统一规定为从接收货物时起至交付货物时止,维持目前关于货物灭失或损坏赔偿限额的规定,同时构建更为完善的举证责任体系。但是,我国不应参考德国海商法改革中关于废除航海过失免责的立法模式。On April 25,2013,the revised Book V " Maritime Trade" of German Commercial Code came into force.China and Germany have similar current economic situation and attitude towards the Rotterdam Rules.The revision of Chinese Maritime Code should draw on the experiences of German Maritime Law,including the period of responsibility of the carrier for the goods,the limitation of the carrier's liability for the loss of or damage to the goods and the burden of proof in marine cargo claims.The deletion of nautical fault of the reform of German Maritime Law should not be adopted by the revision of Chinese Maritime Code.
