摘 要:我国允许国际海运保险的跨境交付,意味着中国保监管会对境外船东互保协会的国际海运保险业务缺乏管辖权。监管的缺位与实务需求背道而驰,亟需在现有法律框架下寻求切入点。强制保险,尤其船舶油污损害民事责任保险的推行,为监管创设了条件。通过比较主要船东国家/地区的立法模式,发现新加坡模式更适合我国,但仍须依"保险监管核心原则",针对现行制度的漏洞,有选择地进行制度移植。Since the international marine insurance is permitted to be cross-border supplied as per the Specific Commitments,the China Insurance Regulatory Commission is lack of jurisdiction to supervise the same. With the implement of compulsory insurance,the authority is able to supervise this matter indirectly. Through comparison with the relevant regulation in the major shipping countries/areas, the Singapore model appears to be more suitable for China. However, a modification based on the insurance core principals and targeting at the loophole of the current regulation is still needed when transplanted such model.
