论全面“二孩”背景下社会抚养费的取消

摘　　要：从超生罚款到社会抚养费,名称的改变并未改变该制度的实质,各地有别的具体措施更引发了对该制度的冲击。不论是民间俗称的"超生罚款"还是官方宣称的"对社会的补偿",社会抚养费都很难在性质上自圆其说。随着全面放开"二孩",取消社会抚养费的法理基础和社会基础都已具备,取消社会抚养费便顺理成章。From the over-birth fine to the social maintenance fees,the change of the name has not changed the essence of the system,and there are other specific measures in different places which have caused the impact on the system. Whether it is a folk custom called ＂over-birth fine＂ or the official claim of ＂compensation for the society＂,social maintenance fees is difficult to say in nature. With the universal two-child policy,the legal basis and social basis of the abolition of social maintenance fees have been provided,and the abolition of social support is logical.
