摘　　要：文章以上海地区河流体系(包括堤岸)不完善的公有产权在上海开埠后所发生的私有化为切入点,揭示乡村城市化过程中水环境问题产生的产权因素。传统农业经济条件下河流体系"似公非公"式的产权观念,与城市土地利用范式下的私有产权意识,存在明显对立,这使得官方和民间在处理河流产权转让时缺乏明确标准和前瞻意识,造成河流水面在短时间内快速消失,带来严重的水环境问题。This paper focuses on the privatization of the public property rights of the river system（ including embankment） in Shanghai region at the beginning of its urbanization,trying to reveal the property rights mechanism of water environment problems in the process of the urbanization of rural countries. ＂The approximate nationalization＂,the concept of property rights of the river system under the agricultural economic conditions,was in sharp contrast to the sense of private property rights of the urban land use,which led to a lack of clear standards and prospective awareness among the official and the public when dealing with the transfer of river property rights. This resulted in a rapid disappearance of rivers from the land surface and brought up serious water environment problems.
