摘　　要：应对网络犯罪,应当在宽严相济的刑事政策之下,根据网络犯罪的自身特点及时调整对策,实现与网络犯罪作斗争的对策适当转型。网络犯罪刑事对策的调整,应当以适度扩张网络犯罪圈的范围、充分发挥网络刑事法的功能、适度前移网络犯罪的刑事防线、有效惩治网络犯罪黑色产业链、深度融合法律规范与技术规则等方面作为主要着力点。To deal with cyber crimes, we should make timely adjustments to our countermeasures according to the special characteristics of the cyber crimes under the criminal policy of combing punishment with leniency, thus realizing an appropriate strategy transformation for fighting cyber crimes. The adjustments to the criminal policy on cyber crimes should focus on the following aspects： among others, expanding moderately the scope of cyber crime circles, giving full play to the function of criminal law, advancing appropriately the criminal defense line against cyber crimes, punishing effectively the dark industry link of cyber crimes, and integrating deeply legal norms and technical rules.
