论规范文本视阈下行政机关首长出庭应诉制度

摘　　要：2014年全国人大常委会通过修正案在《行政诉讼法》中增加了一条作为第三条行政机关首长出庭应诉制度。至2018年,司法机关、行政机关出台司法解释、通知、意见细化行政机关首长出庭应诉制度。但行政机关首长出庭应诉制度仍存在规范设计不够科学、负责人推诿责任、督促乏力、监督缺位等问题。为此应当对法律法规以及规范性文件的起草与执行进行有效管理、加强法院对出庭应诉人员的身份查验工作、充分发挥检察院对行政诉讼的监督职能。In 2014, the standing committee of the National People’s Congress adopted an amendment in the administrative procedure law, which added a third administrative body to the court. By 2018, the judicial organs and administrative organs shall promulgate judicial interpretations, notices and opinions to elaborate the system of responding to lawsuits by the head of the administrative organ. However, there are still some problems such as the lack of scientific design, the responsibility of the responsible person, the lack of supervision, and the lack of supervision. For this shall be for the drafting and implementation of laws, regulations and normative documents for effective management, to strengthen court appearance responses to the identity of the inspection work, give full play to the people’s procuratorate of the supervision of the administrative litigation functions.
