在华“三非”外国人犯罪侦防对策研究

摘　　要：在华"三非"(非法入境、非法居留、非法就业)外国人犯罪具有犯罪主体地域特征明显,人员流动性大、组织团伙化,侵财类案件突出,呈现犯罪职业化倾向等特点。侦查难点在于身份查证难、讯问取证难、对犯罪嫌疑人控制难、境外取证难度大。侦查对策包括:突破"三非"限制,刻画犯罪嫌疑人身份;正视语言障碍,讯问讲究策略;多方协助、控制犯罪嫌疑人;建立侦查翻译人才库,攻克侦查语言障碍。预防对策包括:加强人口管理,打好预防打击基础;及时进行宣传和预警,扩大同类案件知晓范围;提高自身防范意识,主动配合公安机关对在华"三非"外国人的管理。The ＂three illegal acts＂ （illegal immigration, illegal residence, illegal employment） foreigner＇s crimes have these related characteristics in China, such as the obvious regional characteristics of crime subjects, the floating population, the organization of gangs, the cases highlighted in property violation, the tendency of criminal profession- alism and so on. The difficulties for investigation include the identity verification, the interrogation forensics, the con- trol of criminal suspects, and the overseas evidence. The investigation countermeasures include： Firstly, break through the ＂three illegal acts＂ to describe the identity of criminal suspects. Secondly, face the language barrier and pay attention to tactics. Thirdly, multilateral assistance with the control of criminal suspects. Fourthly, establish the talent team of in- vestigative translators to surmount the language barriers of investigation. The prevention countermeasures include： Fir- stly, strengthen the population management and prepared to prevent and preempt them. Secondly, enhance propaganda to public and early warning and expand the knowledge scope of similar eases. Thirdly, improve their own awareness and actively cooperate with the public security organs to manage the ＂three illegal acts＂ foreigners in China.
