公诉人视角下诉讼经济原则的运用与完善

摘　　要：诉讼经济原则在我国的公诉案件中运用频繁,虽然没有明文规定,但是《刑事诉讼法》和《人民检察院刑事诉讼规则(试行)》中的部分条款可被认定为提供了公诉人运用诉讼经济原则的法律依据。公诉人通过只审查其认为"准确、及时查明犯罪事实"所必须审查的法律诉求或理由并作出处理的方式运用该原则。应在尽量避免公诉人被动运用诉讼经济原则的同时,保证公诉人主动运用诉讼经济原则的有效性。诉讼经济原则的运用符合经济因素指引和政治价值取向,但是错误运用该原则将违背节省司法成本的初衷,应从目的和范围两个方面对其运用进行限制。为了更好地发挥该原则的价值,建议从以下几方面进行完善:公检法三家统一运用一套电子卷宗体系;挖掘公诉人的自行侦查权;开展线上附条件不起诉公开听证制度;进一步完善检察机关的法律文书说理制度。The Judicial Economic Principle has been used frequently in criminal cases in China. Although there is no clear stipulation, but the provisions of Criminal Procedure Law and Criminal Procedure Rules of the People＇s Pro- curatorate have provided the legal basis to prosecutors applying the principle. They apply this principle in a manner that only examine the legal appeals or grounds that it deems to be ＂accurate and timely to ascertain the facts of the crime＂. In the meantime, it is necessary to prevent the prosecutors from passive application of the principle, while ensuring the effectiveness of the prosecutors active application of the principle. Although the application of the Judicial Economic Principle was guided by economic factors and political value orientation, it should be restricted from the purpose and scope, for and the error application of the principle would violate the original intention of saving judicial cost. In order to better play the value of this principle, it is suggested to improve from the following aspects： The whole judicial sys- tem, including the procuratorate, the court and the police, adopts a unified electronic file system, the better exploration and application of the prosecutors self-investigation right, trying out the Online Conditional Non-Prosecution Public Hearing System, further improvement of the people＇s procuratorate Legal Document Reasoning System.
