摘　　要：早婚是一种古老而又现实的婚姻现象,其认定标准在于男女的生理成熟状况和社会基本能力,其法律调控主要有婚姻无效和婚姻撤销制度,其中配套实行的早婚例外解禁制度、诉权阻断制度应予废止或彻底修订。Early marriage is an ancient and realistic marriage phenomenon.Its recognition standard lies in the physiological maturity and social basic ability of men and women.The legal regulation mainly includes the system of marriage invalidation and marriage revocation,in which the system of early marriage exceptions and the system of interruption of litigation rights should be abolished or completely revised.
