摘　　要：我国现行无效婚姻制度存在一定的问题,包括婚姻无效与撤销法定范围不合理,没有作出对善意方损害赔偿的相关规定,缺少对当事人所生子女的保护。为此,应从扩大撤销婚姻法定范围,缩小无效婚姻法定范围,重新设计婚姻无效与撤销的法律制度,建立婚姻无效与撤销的损害赔偿制度,保护当事人所生子女等方面,对我国无效婚姻制度进行完善。There are some problems in the current system of invalid marriage in China,including the inefficiency of marriage and the unrevocation of the legal scope,and the lack of relevant provisions on the compensation for the damage of the good intention,and the lack of protection for the children of the parties.Therefore,we should expand the legal scope of the revocation of marriage,reduce the legal scope of the invalid marriage,redesign the legal system of invalid marriage and revocation,establish the system of indemnity for the invalid and revoked marriage,and protect the children,and improve the system of invalid marriage in China.
