摘　　要：惩罚性损害赔偿制度作为我国"消法"中尤为突出的一项制度,对于维护市场交易安全,保证市场交易公平公正具有非常重要的作用,文章以该制度功能探析为视角,分析我国此项制度的现状及不足,并提出完善该赔偿制度的措施,比如将消费者的含义进行明确界定,拓宽惩罚性损害赔偿的适用范围、明确其适用标准、改善其解决途径等,以便更好地服务于我们的消费者以及市场经济。As a system which is especially prominent in the ＂ elimination law＂ of our country,punitive damages system plays an important role in safeguarding the security of market transaction and guaranteeing fair and impartial market transaction,this article aims to further understand the current situation and insufficiency of this system by analyzing the function of this system,and put forward some measures that can promote our compensation system,such as defining the meaning of the consumer clearly,broadening the scope of application of punitive damages,clarifying its applicable standard,improving its solution and so on,in order to better serve our consumers and market economy.
