摘　　要：虚假诉讼在民事诉讼法和刑法修正案(九)中相继入法、入罪,相关法律规制体系初步建立。以"当事人"关系解构为进路、以法益保护为基石,探究现行法律规制体系中存在的一系列问题后,发现虚假诉讼本身并不存在刑民交叉,但在虚假诉讼危害救济途径上却存在刑事实体性制裁与民事程序性制裁的交叉共济。两种制裁的转化衔接是界定虚假诉讼罪与非罪的重要节点,也是司法秩序和他人权益等法益的体系性法律保障。现行虚假诉讼法律规制体系构建进程中的"后盾前移"现象具有其正当性,但伴随规制体系的不断完善,刑法的后盾法规制将实现逐步归位。In The Civil Procedure Law and The Amendment of the Criminal Law （ Ninth）, false litigation entered the law and the crime successively. The relevant legal regulation system was initially established. On the basis of the deconstruction of ＂liti- gants＂ relationship and the protection of legal interest as the cornerstone, a series of problems in the construction of the legal sys- tem of current false litigation are explored. It is found that there is no intersecting between the criminal and the civil in the false lawsuit itself. But there are intersecting and mutual aid between the criminal substantive and civil procedural sanctions in the way of relief for the harm of false litigation. The transformation or connection of the two is an important node in the definition of crime and non - crime of false litigation. It is also the legal protection of legal interests such as the normal judicial order and the legiti- mate rights and interests of others. The phenomenon of ＂backing moving forward＂ in the process of constructing the legal system of false litigation has its legitimacy. With the continuous improvement of the regulation system, the legal system of the criminal code will be gradually relocated.
